Terms & Conditions – Remember Loyalty Club App

Welcome to Remember, the advanced loyalty club app developed by X-mozo for Shopify Plus merchants. By installing or using this app, you agree to these Terms & Conditions.

1. Definitions

  • App: Remember, the loyalty app developed by X-mozo.
  • Merchant: The store owner using the app.
  • Customer: The end-customer purchasing from the Merchant.
  • Points: Digital loyalty points assigned to Customers via the App.
  • Services: Features offered by the App, including points management, promotions, reporting, and integrations.

2. Scope of Service

  • The App integrates natively with Shopify Plus (Shopify Flow, admin blocks, metafields).
  • Features include:
    • Loyalty points system (no order limits).
    • Tier-based loyalty levels.
    • Checkout UI extensions (including anti-fraud validation).
    • Promotions calendar (bonus points, free gifts, mystery boxes).
    • Birthday gifts (if birthday metafield is set).
    • Advanced reporting and analytics (within Shopify).
    • Import/export tools for migrating or adjusting loyalty data.
    • Recovery tools (manual recovery of points, double-encrypted ID retrieval).

3. Merchant Responsibilities

  • Data Accuracy: Merchants are responsible for verifying imports (points, tiers, join dates) and managing promotional rules.
  • Configuration: Merchants must set up birthday metafields, Flow templates, product exclusions, and promotions.
  • Manual Adjustments: Merchants can use admin tools to manually add, remove, or recover points as needed.
  • Custom Orders: Points are not applied to custom admin orders unless manually assigned.

4. Data Privacy & Security

  • No sensitive data (e.g., names, emails) is stored externally.
  • Temporary processing (e.g., for imports) uses secure servers (Fly.io), and data is deleted after use.
  • All customer ID references are double-encrypted.
  • Merchants are responsible for compliance with GDPR, CCPA, and other applicable regulations.

5. Payment & Pricing

  • Monthly subscription: $399 USD per store.
  • Annual plan: $4,299 USD (10% discount).
  • Early bird and custom pricing may apply for initial users (first year, by agreement).
  • Payments are processed via Shopify and subject to Shopify’s billing terms.
  • No partial refunds are provided if the Merchant cancels mid-cycle; service continues until the end of the paid period.

6. Support & Updates

  • Support is provided on business days during standard hours (not 24/7).
  • Merchants will be notified of critical updates (e.g., Flow template changes).
  • Most updates are automatic; manual action may be required for Shopify Flow changes.

7. Deletion & Data Retention

  • If the Merchant uninstalls the app, all loyalty data remains in their Shopify store (customer metafields/metaobjects).
  • No external data is retained beyond what Shopify stores.
  • GDPR requests (e.g., customer data removal) are handled via Shopify's native tools.

8. Limitations of Liability

  • X-mozo is not liable for:
    • Human errors during setup or import.
    • Issues resulting from Shopify platform changes or updates.
    • Merchant misconfigurations or misuse of app features.
  • Merchants are solely responsible for ensuring promotions, points, and rewards apply as intended.

9. Governing Law

These Terms are governed by the laws of [Insert Jurisdiction, e.g., Israel].
